In the 1930s, the Home Owners’ Loan Corporation (HOLC) graded the mortgage security of urban US neighborhoods. In doing so, the HOLC engaged in the practice, imbued with racism and xenophobia, of “redlining” neighborhoods deemed “hazardous” for lenders. Redlining has caused persistent social, political and economic problems for communities of color. Linkages between redlining and contemporary food access remain unexamined, even though food access is essential to well-being. To investigate this, we used a census tract-level measure of low-income and low (...) grocery store food access from the US Department of Agriculture Food Access Research Atlas, redlining data from Mapping Inequality Project, and demographic data from the American Community Survey. We employed generalized estimating equations with robust covariance estimates to analyze data pertaining to 10,459 census tracts in 202 US cities. Tracts that the HOLC graded as “C” (“decline in desirability”) and “D” (“hazardous”) had reduced contemporary food access compared to those graded “A” (“best”). Increases in contemporary census tract proportions of Black, Hispanic, or other racial/ethnic minority residents, as well as disabled residents, were associated with reduced food access. Increases in contemporary proportions of residents age 75 years and older or those without a car were associated with better food access. Tracts that underwent housing redevelopment since being graded had better food access, while those undergoing gentrification had reduced food access. Results suggest that issues of redlining, housing discrimination, racism, ableism, displacement, and food inaccessibility are deeply intertwined. (shrink)

It develops a framework for a comparative epistemology, illustrating the hermeneutic circularity of knowing to accurately and responsibly approach both Western and non-Western philosophy.

Steve Coutinho's Zhuangzi and Early Chinese Philosophy: Vagueness, Transformation and Paradox, is a comparative philosophy project masterfully carried out on two levels, the methodological and the interpretive. Coutinho provides a translation of the Zhuangzi that is both contextually rooted and philosophically rich. Whether or not one agrees with Coutinho's interpretation, there is much to be gleaned from his book. The first few chapters create a meta-philosophical structure that the rest of the book puts to use. Abstract:Short’s assertion that Peirce lacked a cohesive philosophical system is critically examined, and the interconnectedness of Peirce’s 1884–1893 “cosmology” with other aspects of his work is explored, countering Short’s claims of its limited systematic relevance. Additionally, Short’s claim that Peirce “expanded empiricism empirically” is scrutinized, and his interpretation of Peirce’s account of perception is criticized. By contrasting Short’s anti-system reading, I highlight the importance of studying Peirce’s philosophy holistically.

Lane could not have given his monograph a more concise and descriptive title. He never strays from (...) the topics of realism and idealism, and it is remarkably complete. It includes extensive discussion on Peirce's basic realism (Lane's term) as well as his extreme scholastic realism (Peirce's term), his basic idealism (Lane's term), and his objective idealism (Peirce's term). It might not be the best resource for those interested in the historical influences on Peirce's forms of realism and idealism. For instance, if one is interested mainly in Peirce's extreme scholastic realism and its roots in scholastic philosophy, Mayorga (2007)1 might still be a more useful resource. Also, Lane leaves much to be said about the epistemological underpinnings of Peirce's forms of realism and idealism. Peirce's theory of perception and his critical common-sensism do not get much attention. Also, there is much in Peirce's later semeiotic writings that could have been brought to bear on the issues.However, I do not see any of these omissions as failures of Lane's work. As I read it, the book's central aims are to determine the following: (1) what metaphysical views did Peirce hold, (2) when did he hold them, (3) are they consistent with one another, and (4) what is the textual evidence that he held them as such. With respect to these aims, Peirce on Realism and Idealism exhibits the gold standard of Peirce scholarship: it is remarkably sensitive to dates, different writings, and contexts of writings, and the reader gets a strong impression that Lane has not left any stone unturned—that he had at least skimmed every word in every lecture, published writing, letter, and unpublished manuscript that Peirce produced.Although the book contains some interpretations about which I have some reservations, which I describe further on, I agree with most of its central claims. This includes the claim that, despite various developments, Peirce had always subscribed to "basic realism": the thesis that there are things independent of what anyone thinks about them. A whole chapter is dedicated to showing that Peirce's 1868–1869 "anti-Cartesian" papers are consistent with basic realism, and I found that chapter very helpful. Another thesis that Lane defends, and that I strongly agree with, is that Peirce held a representationalist view of truth. In particular, the parts of chapter 6 concerning Peirce's modal realism, while stimulating and enlightening, are also problematic. Further, I do not think that Lane's account of Peirce's idealism appropriately recognizes its similarity to Hegelian or Absolute idealism.To begin with Peirce's modal realism, Lane's discussion of it sets out by addressing the fact that, as Peirce recognizes, the conditionals comprising "pragmatic clarifications," or what result from applying the "pragmatic maxim" to a concept, must be in the hypothetical or subjunctive mood. This is in order to make sense of the truth of even indicative non-conditional propositions such as, to use Peirce's and Lane's example, "the diamond is hard." Idealist and Strong Empiricist approaches to Peirce’s thought are irreconcilable so far as an Idealist interpretation commits Peirce to some form of a priori knowledge, particularly a priori knowledge of the conditions of empirical knowledge. However, while I favor the strong empiricist approach, I agree that there is something like a “condition for the possibility of empirical knowledge” in Peirce, and that this lies with his famous conjecture that, with enough time and experience, there would be a “final result” of (...) all inquiry – “the Final Opinion.” Though some argue that this is mainly a regulative assumption or intellectual hope in Peirce, I contend that he is committed to it as an empirical hypothesis which we should provisionally accept. As an empirical hypothesis, it is not a transcendental constraint on knowledge, though it can be considered a transcendental feature (following Sacks’ (1997) distinction). That is, the thesis explains how knowledge is possible, but the epistemic status of the thesis itself is dependent on the course of experience. Here I explain how it is an empirical thesis and I explain the empirical considerations Peirce thinks support it. Though Peirce should not be considered a transcendental idealist in any robust sense, I give reasons for why he could still be considered a sort of absolute idealist. (shrink)

Abstract:Peirce held a convergence theory of moral truth, as James Liszka persuasively argues in Charles Peirce on Ethics, Esthetics, and the Normative Sciences (2021). Here I emphasize: (1) that Peirce's convergence theory follows from the application of the maxim of pragmatism to the concept of moral goodness or rightness; (2) that in connection with Peirce's account of the ethical summum bonum, morally right action can be understood as action that conforms or contributes to the growth of concrete reasonableness; and (3) (...) that, for Peirce, the growth of concrete reasonableness seems to be a movement or development toward "God". While I broadly agree with Liszka's approach, I highlight some disagreements. As do many readers of Peirce, Liszka seems to regard the convergence of beliefs and habits as necessarily a convergance among the "indefinite community" of distinct persons or inquirers; however, there is sufficient evidence that Peirce came to think that, if any given person were to live long enough, they would come to the same conclusions or rest in the same habits on their own. With respect to morality, even the most evil person would eventually come around to the moral truth. (shrink)

BackgroundCORE (Clarity and Openness in Reporting: E3-based) Reference (released May 2016 by the European Medical Writers Association [EMWA] and the American Medical Writers Association [AMWA]) is a complete and authoritative open-access user’s guide to support the authoring of clinical study reports (CSRs) for current industry-standard-design interventional studies. CORE Reference is a content guidance resource and is not a CSR Template.TransCelerate Biopharma Inc., an alliance of biopharmaceutical companies, released a CSR Template in November 2018 and recognised CORE Reference as one of (...) two principal sources used in its development.MethodsThe regulatory medical writing and statistical professionals who developed CORE Reference conducted a critical review of the TransCelerate CSR Template. We summarise our major findings and recommendations in this communication. We also re-examined and edited the Version 1 CORE Reference Terminology Table that we first published in 2016, and we present this as Version 2 in this communication.ResultsOur major critical review findings indicate that opportunities remain to refine the CSR Template structure and instructional text, enhance content clarity, add web links to referenced guidance documents, improve transparency to support the broad readership of CSRs, and develop supporting resources.The CORE Reference ‘Terminology Table’ Version 2 includes estimand as a defined term and an adaptation of the original ‘worked study example’ to incorporate the recently evolved concept of ‘estimands’.ConclusionsAs TransCelerate’s CSR Template represents an important milestone in authoring CSRs, we offer CSR authors advice and recommendations on its use, similarities, and differences with CORE Reference and advise them to consider shared interpretations between the two.RegistrationCORE Reference is registered with the EQUATOR Network. The proposal that the earth has entered a new epoch called “the Anthropocene” has touched a nerve . One unsettling part of having our ecological finitude thrust upon us with the term “Anthropocene” is that, as Nietzsche said of the death of God, we ourselves are supposed to be the collective doer responsible here, yet this is a deed which no one individual meant to do and whose implications no one fully comprehends. For the pessimists about humanity, the implications seem (...) rather straightforward: humanity will die. Yet, as we will explore in this paper, the death that we may be facing cannot be assumed to be simply biological death or extinction. Indeed, even if we are not running headlong into a mass extinction and biological demise, we do seem to be facing an ontological death. Our ecological finitude is the harbinger of our ontological finitude. The vulnerability we confront in the Anthropocene is what Jonathan Lear, in a different context, called ontological vulnerability. Worlds die too; the ways of life they sustain can become impossible, ceasing to make sense and matter. The constitutive susceptibility of all human worlds to their eventual collapse is what we mean by ontological finitude. This is what we face as presumed denizens in a dawning Anthropocene. (shrink)

As genomic science has evolved, so have policy and practice debates about how to describe and evaluate the ways in which genomic information is treated for individuals, institutions, and society. The term genetic exceptionalism, describing the concept that genetic information is special or unique, and specifically different from other kinds of medical information, has been utilized widely, but often counterproductively in these debates. We offer genomic contextualism as a new term to frame the characteristics of genomic science in the debates. (...) Using stasis theory to draw out the important connection between definitional issues and resulting policies, we argue that the framework of genomic contextualism is better suited to evaluating genomics and its policy-relevant features to arrive at more productive discussion and resolve policy debates. In vitro fertilization using donated oocytes has proven to be an effective treatment option for many prospective parents struggling with infertility, and the usage of donated oocytes in assisted reproduction has increased markedly since the technique was first successfully used in 1984. Data published by the Centers for Disease Control and Prevention on the use of assisted reproductive technologies in the United States indicate that approximately 12% of all ART cycles in the country now use donated oocytes. The increased use (...) of oocyte donation in the United States has prompted discussion regarding risks associated with the process and how best to ensure the safety of oocyte donors.Physical risks associated with oocyte donation include bleeding, infection, ovarian hyperstimulation syndrome and a potential, although unconfirmed, increased risk of developing various forms of cancer, such as uterine, colon, breast, ovarian, and endometrial cancers. This article investigates the moderating effects of organizational social consciousness on the natural environmental competency and innovativeness relationship. Organizational social consciousness reflects the organization’s awareness of its place and contribution to the larger system in which it exists and is developed through an organization’s social responsibility, ethics, culture, corporate values, and the view of its stakeholders. Through our study of key strategic decision makers from organizations located in the USA, we operationalize organizational social consciousness and demonstrate the efficacy of this (...) construct in relation to the organizational-level constructs of environmental management competency and innovativeness. Our results reveal that organizational social consciousness positively strengthens the natural environmental competency to organizational innovativeness relationship. (shrink)

This study analyzes 435 oocyte donor recruitment advertisements to assess whether entities recruiting donors of oocytes to be used for in vitro fertilization (IVF) procedures include a disclosure of risks associated with the donation process in their advertisements. Such disclosure is required by the self-regulatory guidelines of the American Society for Reproductive Medicine (ASRM) and by law in California for advertisements placed in the state. We find very low rates of risk disclosure across entity types and regulatory regimes, although risk (...) disclosure is more common in advertisements placed by entities subject to ASRM's self-regulatory guidelines. Advertisements placed in California are more likely to include risk disclosure, but disclosure rates are still quite low. California-based entities advertising outside the state are more likely to include risk disclosure than non-California entities, suggesting that California's law may have a modest “halo effect.” Our results suggest that there is a significant ethical and policy problem with the status quo in light of the known and unknown risks of oocyte donation and the importance of risk disclosure to informed consent in the context of oocyte donation. In this Article, I assess James E. Fleming’s Fidelity to Our Imperfect Constitution. For Moral Readings and Against Originalisms. For that purpose: in Part II, I reexamine Ronald Dworkin’s “moral reading”; in Part III, I reevaluate Fleming’s argument both “for moral readings and against originalisms”, which can be characterized as “fidelity to our imperfect constitution”; in part IV, I explicit three very helpful dichotomies to distinguish between moral readings, originalisms and legal pragmatism aka living constitutionalism: (1) fidelity and anti-fidelity; (2) (...) interpretation and non-interpretation aka (re)construction, (re)invention and (judicial) legislation; and (3) perfectionimperfection. Additionally, I reintroduce Lon L. Fuller’s distinction between “intelligent and unintelligent fidelity”, to point out the kind of fidelity that moral readers and everyone else must adopt: an intelligent fidelity; and, finally, I present my general conclusion. In this article the author, in the context of the fiftieth anniversary of H. L. A. Hart’s The Concept of Law, reconsiders the moderate indeterminacy of law thesis, which derives from the open texture of language. For that purpose, he intends: first, to analyze Hart’s moderate indeterminacy thesis, i.e. determinacy in “easy cases” and indeterminacy in “hard cases”, which resembles Aristotle’s “doctrine of the mean”; second, to criticize his moderate indeterminacy thesis as failing to embody the virtues of a center (...) in between the vices of the extremes, by insisting that the exercise of discretion required constitutes an “interstitial” legislation; and, third, to reorganize an argument for a truly “mean” position, which requires a form of weak interpretative discretion, instead of a strong legislative discretion.Resumen:En este artículo el autor, en el contexto del cincuenta aniversario de El concepto del derecho de H. L. A. Hart, reconsidera la tesis de la indeterminación moderada del derecho, la cual deriva de la textura abierta del lenguaje. Praising wishful thinking is a serious risk that I am willing to run not only in this article commenting of Natalie Stoljar’s work but also elsewhere in my own scholarship. Although I will analyze her claims and will agree mostly with them, I will criticize her for stopping one step short adopting the desirability or weaker claim, when in it is not merely possible but necessary to go one step beyond arguing for the necessity or stronger claim. Accordingly, I intend (...) to present further grounds for endorsing “conceptual (legal) analysis pluralism” by distinguishing the three different inquiry or projects that are and must be integrated and stating the normative priority of one of them, i.e. the prescriptive, interpretive, and moral.Resumen:Alabar el “pensamiento ilusorio y bien intencionado” es un riesgo que estoy dispuesto a correr no solamente en este artículo para comentar el trabajo de Natalie Stoljar sino además en el resto de mi producción académica. Aun cuando voy a analizar su argumento y voy a estar de acuerdo en la mayor parte con ella, también la voy a criticar por detenerse un paso antes al adoptar la tesis de la deseabilidad o tesis débil, cuando no es meramente posible sino necesario ir un paso más allá al adoptar la tesis de la necesidad o tesis fuerte. In this article the author, in a context in which principles and the principle of proportionality are at the heart not only of jurisprudence but also of constitutional and human rights interpretation, claims that when there were those ready to raise the hand to declare a unanimous winner, some critics and skeptics appeared. In addition, to the traditional objections, they worry that proportionality invites to doing unnecessary balancing between existing rights, inventing new rights out of nothing at all (in detriment (...) of those already well-established ones), and even worse in doing so balancing some rights away. In order to answer to such objections and to reject them, as well as to reinforce the importance of this development, the author: first, revisits the constitution of principles and of the principle of proportionality, which per definitio contradicts each one of this objections; and, then, restates the constitution of the principle of proportionality as a principle of principles not only in constitutional and human rights interpretation but also in legislation, including constitutional reformation, and adjudication.Resumen:En este artículo el autor, en un contexto en el cual los principios y el principio de proporcionalidad están en el corazón no solamente de la filosofía y teoría del derecho sino además de la interpretación en materia constitucional y de derechos humanos, argumenta que cuando había quienes estaban listos para levantar la mano para declarar a un ganador unánime, algunos críticos y escépticos aparecieron. Aunado a las objeciones tradicionales están preocupados por que en su opinión el principio de proporcionalidad invita a hacer un balanceo innecesario entre derechos existentes, a inventar nuevos derechos de la nada (en detrimento de los ya bien establecidos), y que al hacer el balanceo se pierdan derechos. Para responder a tales objeciones y rechazar las mismas, así como reforzar la importancia del desarrollo, el autor: primero, revisita la constitución de los principios y del principio de proporcionalidad, la cual per definitio contradice cada una de las objeciones; y, luego, reestablece la constitución del principio de proporcionalidad como un principio de principios no sólo en la interpretación en material constitucional y de derechos humanos sino también en la legislación, incluida la reforma constitucional, y en la adjudicación. In this article the author focuses mainly in the last part of Ronald Dworkin´s Justice for Hedgehogs and in his argument for a partnership conception of democracy. For that purpose, first, he recalls some of the main features that Dworkin had advanced in previous but intrinsically related works, about political morality, equality and democracy; second, he reassess the arguments for a partnership conception of democracy; third, he reconsiders the resistance produced by Jeremy Waldron in his “A Majority in the Lifeboat” (...) and the response provided by Dworkin, but since it may appear insufficient, he intends to present an alternative —or complemen- tary— riposte in order to meet Waldron’s challenge; and, finally, he insists in the importance of taking Ronald Dworkin seriously.Resumen:En este artículo el autor se enfoca principalmente en la última parte de Justice for Hedgehogs (Justicia para erizos), de Ronald Dworkin y en su argumento a favor de la concepción asociativa o societaria de democracia. In this article the author claims that Waluchow’s “living tree constitutionalism” constitutes a “copernican revolution in our thinking”, because it provides not a mere common law theory of judicial review but a general theory of judicial review and of constitutional democracy. Although agrees that something like the common law methodology is at play here, disagrees on characterizing it as bottom-up. Accordingly, intends to praise the main aspiration of A Common Law Theory of Judicial Review: The Living Tree, i.e. to provide (...) a better understanding of charters and judicial re- view in a constitutional democracy by “the living tree” metaphor; to appraise an unwarranted claim, i.e. to reduce it to the common law bottom-up methodology; and, to raise the alternative with a friendly amendment, i.e. to identify the community’s constitutional political morality via, a method that is both bottom-up and top-down, which is already explicit —or at least implicit— in his account.Resumen:En este artículo el autor sostiene que el “constitucionalismo del árbol viviente” de Waluchow constituye una “revolución copernicana en nuestro pensamiento”, dado que proporciona no sólo una teoría del judicial review, sino una teoría general del judicial review y de la democracia. No obstante que el autor coincide en que en esta teoría de Waluchow existe un lugar para una metodología del common law, discrepa en caracterizarla como una que va de “abajo hacia arriba”. Por lo tanto, el objetivo del artículo es resaltar la importancia del argumento principal del libro A Common Law Theory of Judicial Review: The Living Tree por medio del cual se intenta proporcionar un mejor entendimiento de las garantías individuales y del judicial review, pero advertir una consecuencia innecesaria, es decir, reducir la explicación a una metodología del common law de “abajo hacia arriba”. A su vez el autor pretende proporcionar una corrección amigable: identificar la moralidad política constitucional de la comunidad a través de un método que es tanto de “abajo hacia arriba” como de “arriba hacia abajo”, metodología que se encuentra implícita en el libro de Waluchow. Revisiting the influence of Hans Kelsen in Mexico requires a revision not only of his visits to Mexico and of the Mexicans to him, but also the different accounts of his thought that exist in Mexico. Hence, we commence by remembering his visits to Mexico —from the cancelled to the consummated, including a endless lists of invitations to visit the country; we continue with the visits of the Mexicans to Kelsen; and we conclude with a visit to Kelsen in Mexico, (...) where we proceed to review the bibliography published both of and on him in Mexico or of Mexican authors. For that purpose, I will do a brief recount of his published works and of the existing debates regarding the extent of influence of his thought —or the fidelity of both kelsenians and antikelsenians. Finally, we include a final consideration on the trascendence of his workResumen:Reflexionar sobre la influencia de Hans Kelsen en México obliga a recordar no solamente las visitas a México y de los mexicanos que fueron en su búsqueda, sino además las diferentes visiones que existen sobre él en México. Así, comenzamos con los viajes de Kelsen a México —desde el cancelado hasta el concretado, sin olvidar una infinidad de invitaciones para visitar el país; continuamos con las visitas de los mexicanos a Kelsen; y concluimos con una visita a Kelsen en México, donde revisamos la bibliohemerografía publicada de y sobre él en México o de autores mexicanos. Para tal efecto me permito hacer un breve recuento de las obras publicadas y de las polémicas que existen en torno al grado de in- fluencia de su pensamiento —o fidelidad de los discípulos kelsenianos y hasta de los antikelsenianos respecto al mismo. Extending new verbs is important in becoming a productive speaker of a language. Prior results show children have difficulty extending verbs when they have seen events with varied agents. This study further examines the impact of variability on verb learning and asks whether variability interacts with event complexity or differs by language. Children in the United States, China, Korea, and Singapore learned verbs linked to simple and complex events. Sets of events included one or three agents, and children were asked (...) to extend the verb at test. Children learning verbs linked to simple movements performed similarly across conditions. However, children learning verbs linked to events with multiple objects were less successful if those events were enacted by multiple agents. A follow-up study rules out an influence of event order. Overall, similar patterns of results emerged across languages, suggesting common cognitive processes support children's verb learning. (shrink)

Coronavirus disease 2019 can lead to respiratory failure. Some patients require extracorporeal membrane oxygenation support. During the current pandemic, health care resources in some cities have been overwhelmed, and doctors have faced complex decisions about resource allocation. We present a case in which a pediatric hospital caring for both children and adults seeks to establish guidelines for the use of extracorporeal membrane oxygenation if there are not enough resources to treat every patient. IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion.
